Terms & Conditions

Welcome to our website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Cashel Representation’s relationship with you in relation to this website.

The term ‘Cashel Representation’ or ‘us’ or ‘we’ refers to the owner of the website whose registered office is 39 Commercial Street, EH6 6JD, Edinburgh, United Kingdom. Our company registration number is SC315240. The term ‘you’ refers to the user or viewer of our website. Please read the following booking conditions carefully as they govern all bookings made (whether through Cashel Representation’s website or otherwise) with Cashel Representation Limited.

DMC / End Supplier

Cashel Representation has been appointed the official marketing representation company for the listed Destination Management Companies (DMC). Our primary role is to act as an intermediary between the DMC and the client.

As a marketing representation company, it's crucial to emphasize that our contractual obligations are strictly delineated to the scope of our services as an intermediary between the end supplier/DMC and the client. Our role does not extend to assuming liability for the products or services provided by the end supplier/DMC.

 

This distinction is essential to clarify in our agreements and communications to ensure that our legal responsibilities are accurately understood. While we undertake various promotional activities, advertising campaigns, and sales related endeavors on behalf of the end supplier, any issues or liabilities arising from the products or services themselves remain the sole responsibility of the end supplier/DMC.

The terms set out below apply when you book through Cashel Representation Ltd:

1. General Conditions

(1.1) All prices confirmed by Cashel Representation are net, non-commissionable and are in GBP for the UK and Euro for the Republic of Ireland.

(1.2) All bookings, amendments, and cancellations must be informed to us in writing by email or via our online system. Confirmations will likewise be sent out in writing by Cashel Representation within 24 hours of receipt of the written request. Bookings, amendments, and cancellations will be dealt with during office hours, any correspondence made outside office hours will be dealt with when the office re-opens and will be deemed to be received at that time.

(1.3) Hotels/Theatre/Transfers/Entrances – on request (except where allocations have been agreed). Short-term bookings will be confirmed by return (during our office opening hours) and are not to be considered confirmed until confirmed by us in writing and payment is received within the terms detailed below.

(1.4) Blackout dates or red dates. These dates typically fall on major national holidays or events, supplements might apply. Christmas Day, Boxing Day, New Year's eve, New Year's Day, and Good Friday.

(1.5) All prices specified in the quotation are correct at the date of quotation. Any prices quoted for hotels, attractions, and services may be subject to change and cannot be guaranteed until final confirmation of the booking. All bookings are subject to availability and cannot be guaranteed until final confirmation of the booking. It is the responsibility of the client to ensure that all information provided on which the quotation is based is correct.

2. Deposit

(2.1.1) FIT with 1 or 2 services - no deposit required

(2.1.2) FIT with 3 or more services - An initial deposit of 20% is required at the time of booking.

(2.2) Leisure groups - An initial deposit of 20% is required at the time of booking.

2.3) Incentive groups - An initial deposit of 20% is required at the time of booking.

(2.4) In some circumstances, it may be necessary for us to request additional deposits due to the contracture requirements of our suppliers. Cashel Representation will advise you of the complete conditions attached to any deposits required at the time of confirmation.

(2.5) In the event of the non-payment of any requested deposit, we reserve the right to cancel the reservation.

(2.6) Note that if many extra services are booked after initial confirmation, Cashel Representation may require extra payments. (

) Please note initial deposits (20%) are non-refundable.

3. Confirmation

Following the receipt of the initial deposit, the client will be furnished with a confirmation of the tour details. The client shall immediately notify in writing if any errors are noted. Cashel Representation shall not be responsible for any errors not so notified.

(3.1) Full payment must be received 45 days prior to the tour/program commencement date unless credit facilities agreed.

(3.2) In the event of non-payment by the due date, we reserve the right to cancel the reservation, and in such event all deposits received shall be non-refundable. (3.3) In the event of billing errors, we reserve the right to re-invoice the correct amount.

(3.4) Amendments: In the event of the cancellation of individual participants which results in changes in the number of passengers within the group, Cashel Representation might apply a charge.

4. Payments

Tour payments should be by bank transfer into the following accounts:

(4.3) Bank charges are to be met at the source and should not be forwarded to Cashel Representation. Should Cashel Representation incur bank charges when payment is received, Cashel Representation reserves the right to raise a subsequent invoice for these charges. (4.4) Cashel Representation reserves the right to charge and invoice an additional 6% above Bank of England base rates per month on any overdue amounts. (4.5) Cashel Representation accepts no liability for payments made to incorrect bank accounts or in the wrong currency and will charge for costs incurred in these instances. If a payment is received in the wrong currency, Cashel Representation will charge all the banking fees involved + a handling fee of £200.

 

5. Cancellation Fees

(5.1) Cashel Representation will apply cancellation fees only if applied by suppliers, in particular by hotels. Cashel Representation will try to negotiate lower fees with suppliers on behalf of the client.

(5.2) In the event of an entire group cancellation less than 45 days prior to the Commencement Date cancellation fees could be up to 100% of the total cost.

(5.3) Should individual tour participants cancel services, they may be subject to a cancellation fee. Please note, however, that should a passenger cancellation result in the overall group size dropping into a higher price category, then additional cancellation charges may be levied over and above those quoted below.

(5.4) In the event of “No Show” of individual tour participants, Cashel Representation reserves the right to apply up to 100% cancellation fees.

(5.5) Please note individual services may have different terms and conditions. These will be notified at the time of booking and any special terms and conditions will be advised.

Unless otherwise specified, these cancellation fees will be applicable (FIT is considered up to 10 passengers traveling and Group is over 10 passengers):

(5.1) FIT - cancellation is charged to the following schedule: * Less than 15 days prior to arrival - 100% cancellation charge

(5.2) Leisure group cancellation of the entire group is charged to the following schedule: * Less than 45 days prior to arrival – 100% cancellation charge

(5.3) Incentive group cancellation is charged to the following schedule:

* Less than 60 days prior to arrival - 50% cancellation charge

* Less than 45 days prior to arrival – 100% cancellation charge

 

6. Cashel Representation General Terms Of Booking

(6.1) Cashel Representation will issue a unique reference number with each confirmation. This reference number is to be quoted with the subsequent remittance. Any disputes regarding invoiced amounts must be brought to the attention of Cashel Representation within 14 days. Underpayments without prior agreement will not be accepted.

(6.2) Disputes. In the event of a dispute, we should be informed immediately so we can rectify the matter to our satisfaction. No Financial adjustment will be made unless we receive the initial complaint within 14 days of the client's departure.

(6.3) Office hours - Cashel Representation operates from 9.00 hrs to 17.00 hrs – Monday to Friday. We are closed Saturday and Sunday and on English bank holidays.

(6.4) Liability - Cashel Representation Ltd, acting as an agent for transport companies, hotels, and other suppliers, may not be held responsible in any way for any injury, damage, loss, delay, change of schedule, change of hotel, or any other irregularities caused by such suppliers. No liability can be accepted for loss of luggage or personal injury. Furthermore, no liability can be accepted arising from the insolvency or bankruptcy of any transport companies, hotels, and other suppliers. No liability can be accepted for acts of terrorism, pollution, contamination, or hazardous materials (e.g., asbestos), natural disasters, or for delays or cancellations incurred as a result. Furthermore, Cashel Representation Ltd. will in no event be liable for any loss of profit due to or arising from the negligence of this company or their servants, agents, or sub-contractors. Any booking made with Cashel Representation Ltd. assumes acceptance of these terms and conditions. In the event of a breach of contract owing to unforeseeable events, for example, strikes by airlines or cancellation of services due to volcanic ash, Cashel Representation Ltd. retains its right to charge in full for all services it cannot reclaim money for. Contracts are subject to Scottish law and Scottish jurisdiction.

(6.5) VAT is based on the level currently in the United Kingdom and the Republic of Ireland. Should the rates change, Cashel Representation Ltd. reserves the right to alter rates accordingly.

(6.6) Proper Law - Any agreement made by us shall be governed and interpreted in all respects in accordance with the Scottish Law of bookings. Cashel Representation Ltd. operates within all clauses as specified in the EU package travel directive.

(6.7) Gratuities are not included for the motorcoach driver and tour guide.

(6.8) Any services added while the group is traveling will have to be paid to Cashel Representation by Credit or Debit card, as soon as confirmed.

(6.9) Proprietary Rights The concepts, treatments, and production techniques detailed in this proposal remain the exclusive property of the Tour Operator until such time we are contracted to execute them. They may not be developed or produced by any other parties without the express written consent of the Tour Operator. Unauthorized use of the attached material, including, but not limited to, the solicitation of other bids, will be considered a breach of propriety, under which this proposal has been developed and submitted.
